Expired Provisional Planning Permit: Lagos to commence enforcement of applications for final permit
The Lagos State Government in a demand notice has urged holders of expired Provisional Planning Permits to submit their applications for Final Planning Permits as quickly as possible before they commence enforcement actions after one month.
The charge was given by the Lagos State Commissioner for Physical Planning and Urban Development, Dr Idris Salako, who explained in a chat with a section of the media in his office on Tuesday that the Provisional Planning Permits issued by the Lagos State Physical Planning Permit Authority (LASPPPA), pending the procurement of Registered Title from Lands Bureau, were previously valid for 18 months.
Salako said that all such expired Planning Permits were no longer valid and should be deemed illegal, irrespective of the status of the construction of the building involved, whether completed or not.
The commissioner revealed that the Lagos State Government had already made public a list of more than 500 expired Provisional Planning Permits, adding that more lists would soon be published in batches.
He advised property owners and developers in possession of expired Provisional Planning Permits to process the application for their Final Planning Permits within one month as expired Provisional Planning Permits have seized being tenable for building construction in the State.
He warned that the Ministry and its agencies would, in line with the Lagos State Urban and Regional Planning and Development Law 2019 as amended, commence necessary enforcement actions against property with expired Provisional Planning Permits after the one-month ultimatum.

Provisional Planning Permit refers to the temporary permit granted to applicants before the issuance of the final permit. This could be granted to applications before they obtain the registered Certificate of Occupancy or consent or ratification as applicable.
